At a recent event in Rajkot, former Supreme Court judge Rohinton Fali Nariman voiced serious concerns regarding the state of voting rights in India. He pointed to significant issues with the Election Commission’s operations, which have resulted in widespread voter disenfranchisement.

Nariman’s remarks came amid an ongoing debate about the current process for appointing the Chief Election Commissioner (CEC) and other Election Commissioners. He criticized the 2023 legislative changes, which have controversially shifted the power of appointment to a committee predominantly controlled by the government, sparking fears of reduced transparency and independence in the electoral process.

Urgent Supreme Court Intervention Needed

Addressing an audience at Rajkumar College, Nariman urged the Supreme Court to take swift action to address what he described as “disturbing developments” within the poll commission. He stressed that the functioning—or malfunctioning—of the Election Commission poses a severe threat to the fundamental democratic right to vote, enshrined in India’s Constitution.

He called these developments a matter of “great peril” and underscored that unless immediate corrective measures are implemented, the very essence of Indian democracy could be at risk. He emphasized the necessity for the country’s apex court to provide oversight and restore integrity to the electoral process.

Justice Nariman’s comments are in reference to the Supreme Court’s Anoop Baranwal case judgment in 2023, which examined the criteria for appointing election commissioners. His critique is particularly focused on the exclusions made by the new law that affect the independence of the Election Commission, given its increased susceptibility to government influence.

This discussion resonates with ongoing concerns about democratic integrity and the mechanisms essential for safeguarding fair elections. The mass voter deletions and alleged malfunctions during the Special Summary Revision exercise underscore the urgency of addressing these systemic issues.
